Contest Period: Work From Hawaii (the “Contest”) begins 10:00 a.m. Eastern Time (“ET”) on April 30, 2018 and ends at 11:59 p.m. ET on June 4, 2018 (the “Contest Period”).
Eligibility: Open to legal United States residents, who live and work in the greater New York metropolitan area, between 24-36 years of age inclusive as of date of entry, have/post to a public Instagram account, and are able to work from Hawaii in September 2018. For purposes of the Contest and these Official Rules, the person submitting the Entry (as defined below) is considered the “Entrant” and his/her entry is deemed the “Entry”. For purposes of the Contest and these Official Rules, “work” is defined as conducting duties regularly for wages or salary for one’s business or vocation or duties surrounding a passion or side project. Employees of Hawaii Tourism United States (“Sponsor”), Don Jagoda Associates, Inc., their respective affiliates, parents, subsidiaries, divisions, suppliers, distributors and advertising, promotional and judging agencies (collectively “Sponsor and its Administrators”), and each of their respective employees, shareholders, directors, officers, members and agents and their immediate family members spouses, parents, children, and siblings and their spouses) and/or those living in the same household of each are not eligible to participate or win. All federal, state and local taxes are the sole responsibility of winner. Void outside of the greater New York metropolitan area and where prohibited by law and subject to all federal, state, and local laws.
How To Enter: To enter, you must visit www.work-from-hawaii.com (the “Site”), complete the registration, and selecting the “Work Residency” that resonates most with you and you’d like to apply for. The Work Residencies available are: (i) Location Scout; (ii) Design Loft; (iii) Writer’s Desk; (iv) Tech Lab; (v) Sound Space; and (vi) Corner Office. Then, you must follow the instructions to enter using your LinkedIn account (optional) and outline what you would work on during the Work Residency, why working from Hawaii would help you return better at your craft, include background on your work experience (either by describing your work experience or by providing links to work-related materials), and provide the link to your public Instagram profile (collectively, “Submission”). There is a limit of one (1) Submission per Entrant for the entire Contest Period. Submissions must be in English. By entering, you understand that your Submission in its entirety or portion thereof may (in Sponsor’s sole discretion) be posted on websites, Social Media sites and/or other Sponsor-selected media. All online Submissions must be completed and submitted by 11:59 p.m. ET on June 4, 2018. Normal data/Internet access and usage charges imposed by Entrants’ online/phone service will apply.
Submission Requirements: To be entered into the Contest, Entrants must comply with registration instructions when submitting their Submission. The Submission may not contain obscene, profane, lewd, defamatory or inappropriate images or text including no nudity, acts of violence or acts that appear to cause harm or are illegal/dangerous, as determined at Sponsor’s sole discretion. Any Submission or portion thereof that is, in the Sponsor’s sole discretion, obscene, profane, lewd, defamatory, highlights brand in a negative way, contains any third party materials, or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including, but not limited to, rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may disqualify the Entrant. Entrants may include the name of the company they work for in their Submissions, if applicable. Entrants may not copy or otherwise plagiarize the Submission from any source. If submitting a photo/video depicting other individuals, you must make the other individuals aware that you are entering a photo/video and attest that the other individuals have agreed that you may submit such photo/video and you must be the parent/legal guardian of any minors featured in the photo/video. Sponsor has the sole discretion to determine whether a Submission qualifies. All Submissions must be the sole, original work of the Entrants. Entrant’s social media profiles must be keeping with Sponsor’s image or he/she may be disqualified. By submitting a Submission, you hereby grant the Sponsor, its affiliates, subsidiaries, assigns, licensees, designees and legal representatives the irrevocable, perpetual, worldwide digital and other rights to use, reproduce, edit, market, store, distribute, have distributed, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, and promote the Submissions or excerpts of Submissions (as such may be edited and modified by the Sponsor at its discretion) for editorial, commercial, promotional and all other purposes (including posting on Sponsor-affiliated websites, Social Media sites and/or other Sponsor-selected media). In addition, you hereby assign to the Sponsor all rights, titles, and interests that you may be deemed to have in any reproduction, product, or derivative work using or incorporating the Submission. You further agree to waive any moral rights in and to the Submission. Automated, script, macro or robotic Submissions submitted by individuals or organizations will be disqualified. If, at Sponsor’s sole discretion, the Submission appears to have resulted in any injury or bodily harm, it will be rejected. Any Submission not in compliance with the above and does not meet the Site’s requirements will be disqualified.
Finalists, Judging and Winner Notification: All Submissions will be judged by Sponsor-selected judges (“Judges”) on or about June 15, 2018 based on the following criteria: Most Compelling (25%); Social Media Presence (25%); Suitability for Promotional Use (25%); and Enthusiasm about the Prize (25%) (the “Judging Criteria”), to determine a maximum of four (4) Finalists per Work Residency (24 total). Any tied Submissions will be re-judged by the judges based 100% on Most Compelling to determine the applicable Finalist(s). Finalists will be notified via email and will be required to verify their eligibility and verify a phone number so they may participate in an interview (either on the phone, in-person, or via video chat) with Sponsor within 48 hours of notification attempt or prize will be forfeited and an alternate Finalist will be determined. Sponsor will determine time and duration of interview – to occur mid – late June 2018. Finalists will then be re-judged based 25% on the phone interview and 75% on the Judging Criteria to determine one (1) Grand Prize winner per Work Residency (6 total). Finalists will then be re-judged based 25% on the phone interview and 75% on the Judging Criteria to determine one (1) Grand Prize winner per Work Residency (6 total). Any tied Finalists will be re-judged by the judges based 100% on Most Compelling to determine the applicable Grand Prize winner(s). Judges’ decisions are final with respect to all matters relating to the Contest. By participating, Entrants agree to the Official Rules and the decisions of the Judges, which shall be final and binding in all respects.
Grand Prize and Approximate Retail Value (“ARV”): Grand Prize (6 total – 1 per Work Residency): An 8-day/7-night trip for Grand Prize winner only to a work from Hawaii on Sponsor-selected dates in September 2018. Trip includes round trip coach class air transportation from a New York City area airport to Hawaii; seven (7) nights’ accommodations (based on single occupancy); access to a specialized workspace for up to five (5) days; the opportunity to participate in three (3) Sponsor-selected activities relating to cuisine, culture, and adventure; and a $2,500 check made payable to the Grand Prize winner to be used to help offset taxes (ARV: $10,000 each). Prizes are awarded “as is” without any warranty or guaranty of any kind. Prizes are not transferable. Prizes will be awarded provided a sufficient number of eligible Submissions are received per Work Residency. Grand Prize winner also agrees that Sponsor or its agents may photograph, videotape or record any aspects of the Grand Prize trip (“Grand Prize footage”) and use that Grand Prize footage or excerpts of that Grand Prize footage in any way they see fit. Grand Prize winners will be required to document their experiences in Hawaii and create social media content (including photos and stories) to provide a first-person perspective of their time working from Hawaii (“content”) and submit the content to Sponsor. Sponsor reserves the right to provide winner with details of specific content they wish for winner to capture and winner agrees to abide by the “Do not Promote” content guide, which will be included with winner documents. Sponsor may use this content in any way it sees fit, including posting on any of their social media sites/websites and potentially other mediums. In addition, Grand Prize winner must be willing to capture and post at least five (5) pieces of content on their social media profiles (which must be public). Grand Prize winners must be able to work (perform their normal course of business or vocation or passion/side project) from Hawaii for at least two (2) days during the Work Residency.
Grand Prize Rules: Grand Prize winners will be required to participate in two (2) one-hour phone calls, video chats, or in-person discussionswith the Sponsor prior to leaving for Hawaii. Grand Prize winnerswill also be required to participate in one (1) additional interview after the Grand Prize trip (the “post-residency interview”)to be recorded as voiceover for use in promotional materials after the Grand Prize trip (the “post-residency interview footage”). Phone call dates/times will be determined by the Sponsor. Airline carrier's regulations and conditions apply. Trips may not be combined with any other offer and travel may not qualify for frequent flyer miles. Grand Prize winners must possess valid travel documents (i.e., valid government issued photo ID) in order to travel. Seat selection and timing of trip subject to availability and confirmation of reservations. Certain restrictions apply including black-out dates. Trip must be taken on dates specified by Sponsor in September 2018 or prize will be forfeited. Grand Prize winners must be able to travel/participate in all aspects of the Grand Prize trip/calls or prize will be forfeited in its entirety. Travel must be round trip. Sponsor will not replace any lost, mutilated, or stolen travel vouchers or certificates. No refunds or credit for changes are allowed. All other expenses and costs, not expressly listed above, including, but not limited to, taxes, tips, incidentals, passenger tariffs or duties, airline fees, surcharges, airport fees, service charges, personal charges at lodging, security fees, entertainment and transfers, are each Grand Prize Winner’s sole responsibility. No substitution or transfer of prize permitted except at the sole discretion of the Sponsor who reserves the right to substitute prize (or portion of prize) of equal or greater value in the event the prize is unavailable or cancelled for reasons out of Sponsor’s control. Grand Prize winners will be responsible for any other costs or expenses associated with the prize, including payment of applicable income taxes. In the event a Grand Prize winner engages in behavior that (as determined by Sponsor, in its sole discretion) is inappropriate or threatening, illegal or that is intended to annoy, abuse, threaten or harass any other person, Sponsor reserves the right to terminate the trip early, in whole or in part, and send the Grand Prize winner home with no further compensation to the Grand Prize winner. Potential Grand Prize winners understand and agrees that, as a condition of being awarded the prize, he/she may be subject to a background check at the sole discretion of Sponsor; failure to comply may result in disqualification and forfeiture of prize. In addition, at the discretion of the Sponsor, potential Grand Prize winner may be disqualified: (a) if charged with or convicted of a felony or misdemeanor; (b) if Sponsor determines, in its sole discretion, that awarding the prize to such individual may reflect unfavorably on the Contest or Sponsor; (c) if he/she is not eligible to receive the prize based on the eligibility requirements set forth in these Official Rules; (d) if Sponsor determines that he/she failed to comply with these Official Rules in any way; or (e) if he/she refuses to or cannot accept the prize for any reason.
General Rules: Each potential Grand Prize winner will be required to sign and return an Affidavit of Eligibility and Liability Release, tax documents, and except where prohibited, publicity release and assignment of rights (“Affidavit”) within forty eight (48) hours of notification in order to be determined a Grand Prize winner. If Entrant fails to return the completed Affidavit within forty-eight (48) hours, Affidavit is returned as undeliverable, Entrant shall be deemed to be ineligible, the Prize will be forfeited and an alternate potential Grand Prize winner will be determined, time permitting. Affidavit will be sent to the Entrant via email. Return of prize notification as undeliverable may result in disqualification and alternate determination, time permitting. Grand Prize winners and all Entrants, as a condition of entry into the Contest, agree to release Sponsor and its Administrators, Instagram, LinkedIn, each of their respective agencies, parents, subsidiaries, affiliated companies and each of their respective officers, directors, shareholders, members, employees, agents, assigns, and all others associated with the development and execution of this Contest (collectively the “Released Parties”) from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with creation of or submitting a Submission or otherwise participating in any aspect of the Contest, the receipt, ownership or use of prizes awarded or any typographical or other error in these Official Rules or the announcement or offering of the prizes. Acceptance of prize constitutes permission to use Grand Prize winners’ names, likenesses and Submissions and Grand Prize footage/content for promotional purposes (including any possible public relations opportunities) without further compensation except where prohibited by law. By participating in the Contest, Entrants/Grand Prize winners agree to be bound by the Official Rules and the decisions of the Judges. The Sponsor and its agencies are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in the Contest or by any human error which may occur in the processing of the Submissions in the Contest or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with the Contest. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Contest; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. In the event of a dispute as to the identity of an online Entrant, the authorized account holder of the email address used to enter will be deemed to be the Entrant. “Authorized account holder” of an email address is defined as the natural person who is assigned to an email address by an Internet Access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, then the Sponsor reserves the right at its sole discretion to cancel the Contest and determine the Finalists from among all eligible Submissions received per Work Residency prior to cancellation, based on the Judging Criteria listed above. These Official Rules cannot be modified or amended in any way except in a written document issued in accordance with law by a duly authorized representative of Sponsor. You hereby represent and warrant that you have read these Official Rules and are fully familiar with its contents. Submissions generated by script or bot are not eligible. As a condition of entering the Contest, Entrant/Grand Prize winners agree that: 1) under no circumstance will Entrant/Grand Prize winners be permitted to obtain awards for, and participant hereby waives all rights to claim punitive, incidental, consequential or any other damages, other than for out-of-pocket expenses; 2) all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and 3) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees.
Conditions: Grand Prize winners acknowledge and agrees that Sponsor has the right to edit, adapt, modify, reproduce, promote and otherwise use the Submission/Grand Prize footage/content in any way it sees fit in connection with advertising in any medium, throughout the world, in perpetuity. Entrant/Grand Prize winners shall have no right to review or approve edits, alterations or modifications, and the Entrant/Grand Prize winners waive the benefit of any provision of law known as “moral rights.” No information regarding Submissions or judging will be disclosed to any third party not involved in the conduct of the Contest. By submitting a Submission, you represent: (a) that the Submission is your own original work that has not previously been published or publicly shown or won a prize or award; and (b) any and all rights to the Submission belong to you and the Submission does not infringe, misappropriate or violate the rights of any third party. Further, any Submissions that Sponsor, in its sole discretion, deems to be inappropriate for publication will not be considered.
